 BC Land Title Registry
~ Assured title upon registration in a public registry ~ The Land Title Act provides the legal framework for the BC land registry system and is a modified version of the Torrens System which establishes security and simplicity of legal title through registration of conveyancing documentation in a public register. Documentation transferring legal ownership that is properly filed with, approved by, and registered with, the BC Land Title Office establishes indefeasible title in the Land Title Office register which cannot be defeated or revoked – parties who acquire title to lands in this manner and subsequent parties who deal with such lands are entitled to rely on the register for assured legal title and are not affected by notice with respect to any unregistered interests affecting the lands To insure fairness and protection to both owners and purchasers of BC property under this system there is provision in the Land Title Act; - to ensure legal certainty of land title for a party acting in good faith who unknowingly acquired a fee simple interest in the property through a forged transfer provided the acquiring party did not participate in the fraud, and; - to allow compensation where a party is deprived of title due to an error in the operation of the Land Title Act or in the administration of the land title system under the Registrar’s direction, and; - to allow compensation to a party whose loss of title is partially a result of administrative error of the Registrar and partially a result of the party’s own actions Note: A limited number of exceptions apply to the principles of indefeasible title and notice requirements respecting any unregistered interests and certain circumstances apply for compensation applications. It should also be noted that provisions cover compensation for loss of title and may not result in return of title.
