Land ownership in BC - in general, the vast majority of the surface land base in BC is owned by the provincial Crown with only about 8% being held privately or by the federal Crown.

Title to land and registration of land ownership and interests is established under the "Torrens" system of land registration which is based on the primary principle that upon the issuance of a title that title is proof of the registrant's ownership interest in and to such land and interests.
The province has enacted legistative provisions for compensation claims by persons who suffer a loss as a result of erroneous title registrations or registrations unauthorized at law (see our "Land Title Registry" page for further information).

Mineral rights ownership in BC

Virtually all subsurface mineral rights to lands in the northern porion of BC are owned by the provincial Crown either through unpatented land areas, mineral exceptions contained in original land grants, or through forfeitures and resulting re-grants.

However, in areas of early settlement such as the lower mainland of BC, Vancouver Island and the Gulf Islands and in areas of early railway development extensive research is usually necessary to determine Crown or private mineral ownership as subsurface title is normally uncertain due to historical anomalies arising through the issuance of Crown and Railway Land Grants, Also, registration of subsurface mineral rights through the years was not required and even where registration has occurred the minerals being claimed may not be clearly identified and it is necessary to research the title history of properties to determine mineral ownership.


Land Title & Survey Authority - is the agency responsible for registering and managing BC's land title and land survey systems. It is a not-for-profit organization that operates independently from the provincial government but in accordance with government legislation.

Land Title Districts - there are seven Land Title Districts in British Columbia :
Kamloops, Nelson, New Westminster, Prince George, Prince Rupert, Vancouver and Victoria

Land Title Offices - there are three Land Title Offices in British Columbia:
Victoria - administers the Vancouver Island and adjacent Gulf Islands districts
New Westminster - administers Vancouver, Lower Mainland and Prince Rupert districts
Kamloops - administers the Kamloops, Nelson and Prince George districts

Land Titles Office Registries and related Crown registries - contain legal title information about property in BC, including historical information dating back to the original patents or land grants by the earliest governing bodies including the Hudson's Bay Company. Documentation covering land/property sales, grants, transfers, forfeitures, re-grants, assessments, encumbrances, litigation, taxes, mortages, easements, rights-of-way, surveys, plans and any other documentation affecting ownership of lands or properties (both surface and undersurface rights) are available to the public and copies can be retrieved and provided with proper searching, or required information can determined through knowledgable research and document analyzation.

Proposed legislation affecting mineral title - In 2002, the Ministry of Energy, Mines and Petroleum Resources began researching private mineral title in B.C. with the intent of initiating future legislation (Mineral Title Clarification Act) to provide for the determination, confirmation and registration of private mineral title.


Recognition of historical aboriginal rights remain as an outstanding issue in all parts of British Columbia and has been the subject of several court cases in recent years. Staged First Nation land claim negotiations are currently taking place in many areas involving, amoung other things, matters of resource management, consultation, governance and jurisdictional issues.
